These Terms & Conditions govern access to and use of www.naseematelier.com and purchases offered through the website. References to Naseem Atelier, we, us, or our refer to the business operated under the legal/registered name MISNA A M, as applicable.
1. Website Usage
Use the website only for lawful purposes. You must not use it for fraud/unlawful purposes, gain unauthorised access, interfere with security/operation, introduce malware, collect other customers’ information without authorisation, improperly scrape the site, impersonate others, provide false information, or use our content/intellectual property without permission.
2. Eligibility
By using the website or placing an order, you confirm that you are legally capable of entering into a binding transaction under applicable law. Minors should use the website/purchase only with appropriate parent or guardian involvement where required.
3. Customer Accounts
Where accounts are available, you are responsible for keeping credentials secure and should contact us promptly if you believe access was unauthorised.
4. Product Information & Descriptions
We make reasonable efforts to accurately describe and display products. Slight differences may arise from screens, photography, lighting, fabric characteristics, dye/manufacturing variation or print placement. Minor non-material differences may not constitute defects.
5. Product Sizing
Customers should review size charts and measurements before ordering. Sizing and fit can vary between styles, fabrics, silhouettes and collections.
6. Product Availability
All products are subject to availability. Adding an item to the cart does not guarantee reservation. If an item becomes unavailable, we may offer an alternative, replacement or refund as applicable.
7. Pricing
Prices are displayed on the website and may change. The applicable purchase price will normally be the amount displayed and confirmed at checkout, subject to correction of obvious errors. Shipping and applicable charges will be shown before completion.
8. Pricing Errors
If an obvious pricing error occurs, we may correct it and, where an order has been placed, contact the customer with appropriate options including cancellation/refund where applicable.
9. Promotions & Discount Codes
Promotions may be subject to eligibility, minimum spend, validity periods, exclusions or other conditions. Promotional benefits may be refused where obtained through misuse, fraud, technical error or violation of terms.
10. Orders & Order Placement
Customers are responsible for checking product, size, colour, quantity, name, email, phone, shipping address, billing and payment information before completing an order.
11. Order Acceptance
We may reasonably decline/cancel an order due to product unavailability, incorrect pricing/information, payment failure, suspected fraud, invalid/incomplete information, shipping restrictions, technical errors or other circumstances preventing fulfilment. Paid cancelled orders will be refunded as applicable.
12. Payment
Customers must pay the checkout total using an available payment method, which may include credit/debit cards, UPI, net banking, wallets or other supported methods.
13. Payment Processing
Payments may be processed through authorised third-party gateways, banks, card networks, UPI providers or financial-service providers. We do not require customers to provide card PINs, UPI PINs, banking passwords or similar confidential authentication credentials directly to us.
14. Fraud Prevention
We may perform reasonable checks, temporarily hold, review or cancel suspicious transactions and request reasonable verification information subject to applicable privacy requirements.
15. Shipping & Delivery
Orders are generally processed within 1–3 business days. Estimated post-dispatch delivery within India is generally 2–5 business days for metro/major cities, 3–7 for other cities/towns, and 5–10 for remote/difficult-to-service locations. Full terms are in our Shipping Policy.
16. Shipping Address
Customers must provide complete and accurate delivery information. Address changes after dispatch cannot be guaranteed, and re-dispatch charges may apply for customer-supplied address errors.
17. Order Tracking
Where available, tracking information is generally provided after dispatch. Contact naseematelier@gmail.com with your order number for tracking issues.
18. International Orders
Naseem Atelier primarily serves India. Selected international shipping may be available. Unless stated otherwise, destination customs duties, import taxes, VAT, clearance fees and similar charges are the customer/recipient’s responsibility.
19. Returns & Exchanges
Eligible exchange requests must generally be made within 7 days of delivery. Clothing must be unworn, unwashed, unused, unaltered, free from stains/odours/signs of use, with original tags, and in saleable condition. Full details are in our Return, Refund & Cancellation Policy.
20. Size Exchanges
Eligible size exchanges may be requested within 7 days, subject to availability. For normal size exchanges, customer return/re-shipping charges may apply. If we sent the wrong size, we bear reasonable correction costs.
21. Sale & Discounted Products
Sale, clearance, promotional and discounted items are generally not eligible for return/refund solely for change of mind. Final Sale/No Return/No Exchange items generally do not qualify for change-of-mind return/exchange, subject to applicable law.
22. Damaged, Defective or Incorrect Products
Contact us as soon as possible and preferably within 7 days of delivery. We may request the order number, issue description, product/packaging photographs and other reasonable information. Approved claims may be resolved through exchange, replacement or refund.
23. Refunds
Approved refunds are generally initiated within 5–7 business days to the original payment method. External banks/payment providers may require additional time to reflect the amount.
24. Cancellation
Customers may request cancellation before dispatch by emailing naseematelier@gmail.com with their name and order number. Once dispatched, orders cannot normally be cancelled. Approved cancellation refunds are generally initiated within 5–7 business days.
25. Intellectual Property
Unless otherwise stated, brand names, logos, product photographs, graphics, website design, product descriptions, text, artwork, fashion-related creative content, promotional materials, videos and layout are owned by, licensed to or used with permission by Naseem Atelier/MISNA A M and protected by applicable intellectual-property laws.
26. Third-Party Services
The website may rely on Shopify, payment processors, courier companies, analytics, email, marketing and other technology providers. We are not responsible for failures solely caused by third-party systems outside our reasonable control, subject to applicable law.
27. Website Availability
Uninterrupted/error-free access is not guaranteed. The website may be unavailable due to maintenance, technical/hosting/security issues, upgrades, third-party interruptions or circumstances beyond our reasonable control.
28. Limitation of Liability
To the maximum extent permitted by applicable law, Naseem Atelier/MISNA A M will not be liable for indirect, incidental, special or consequential losses arising solely from use of or inability to use our website/services where such liability may lawfully be excluded. Nothing excludes liability or mandatory consumer rights that cannot legally be excluded.
29. Customer Responsibilities
Customers are responsible for accurate order/address information, appropriate product/size selection, reviewing descriptions, following garment-care instructions, keeping credentials secure, using lawful payment methods, reasonably inspecting orders and contacting us within applicable periods.
30. Privacy
Use of the website and handling of personal information are governed by our Privacy Policy.
31. Governing Law
These Terms & Conditions and transactions through Naseem Atelier are governed and interpreted in accordance with applicable laws of India, without prejudice to mandatory consumer rights. Disputes will be handled according to applicable Indian law and jurisdictional requirements.
32. Changes to These Terms & Conditions
We may update these terms to reflect changes in operations, products/services, website functionality, payment/shipping arrangements, policies or applicable law. The latest version will be published with an updated revision date.
33. Severability
If a provision is invalid, unlawful or unenforceable, the remaining provisions continue to apply to the extent permitted by law.
